PROPERTY WATCH SERVICE AGREEMENT

1. Purpose of Agreement

The purpose of this Agreement is to state the duties and obligations of J.W. Oliver Family Investments, LTD. (referred to from here on as Ohana Concierge) and the Client as well as to specify the respective care and handling of the property and/or other services Client desires. The referenced property information is fully described in Schedule “A” of this Agreement and said information is necessary for service commitment.

2. Approvals and Authorization

Client hereby agrees and contracts with Ohana Concierge for the services stated in this Agreement, and for all other rendered services as requested by Client herein or in the future, and Client agrees to provide prompt payment for all such services as set out in Schedule “B” attached hereto. Client hereby expressly represents and warrants that it is the legal and beneficial owner of the property that is the subject of this Agreement, or that it has full and complete authorization to enter into this Agreement on behalf of the property owner of said property. Client has further full authority to permit home and property access including all gated community access points. Client shall be responsible to inform all home and community security entities of this Agreement to have Ohana Concierge personnel enter the community and access the property. False, inaccurate or incomplete information shall be the responsibility of the Client and shall void all responsibility of Ohana Concierge.

3. Indemnity

The Client hereby agrees to indemnify and hold harmless Ohana Concierge, as well as its shareholders, directors, agents, representatives and employees, from any and all liability that may result from all damage or loss in connection with the provision of the services described within this Agreement, and from all liability for injuries to persons or property suffered or sustained by any person whomsoever, and Client agrees to carry adequate property and liability insurance to protect the interest of parties hereto.

4. Damages or Missing Items

Client hereby expressly agrees that Ohana Concierge. will not be held responsible for any damage to the property or items missing, switched out, lost, damaged or stolen under any circumstances including, without in any way limiting the generality of the foregoing, this may include but is not limited to damage or loss due to theft, vandalism, negligence of invited or uninvited individuals, or acts of nature.

5. No Guarantees

Client expressly acknowledges and agrees that the services that are the subject of this Agreement are for observation and reporting only. Ohana Concierge cannot and does not guarantee the safety or condition of the property, nor does it guarantee or warrant against breakin, vandalism or other acts of nature. The purpose of this Agreement is solely for scheduled observation and inspection, which increases the chances of early problem detection before damage is created. Should a false alarm occur, Ohana Concierge shall not be responsible for any costs incurred as a result of the false alarm while following Client’s instructions for alarm operation.

6. Termination

Either party may terminate this Agreement with 30 (thirty) days’ advance written notice. Client shall submit all fees due and payable to Ohana Concierge within 10 (ten) days of receipt or provision of termination notice. Upon expiry of said thirty (30) day notice period, Ohana Concierge shall return all keys, codes, and any other means of property access to Client.

7. Authorization and Approvals

Client hereby expressly acknowledges, represents and warrants that:

  1. The information provided by Client and set out in Schedule “A” attached hereto is accurate and complete. Inaccurate or incomplete information is the responsibility of the Client and Ohana Concierge is hereby released from all responsibility and/or liability with respect thereto.

  1. This Agreement confirms the approval for limited access to the Client’s property for property monitoring services and reporting only.

  1. Any emergency will be handled as detailed in this Agreement and subject to fees terms and conditions as set out herein.

8. Service Agreement

Ohana Concierge requires this Service Agreement for all services that it will provide to Client to ensure a complete understanding of all services expected. This Agreement must be signed by the Client before any work can begin.

9. Billing

Client will be billed for the services rendered by Ohana Concierge one month in advance of Property watch starting. Payment is required no later than ten (10) days from receipt of invoice. Late payments are subject to a ten percent (10%) per annum late fee and $25.00 fee for all returned checks.

10. Acknowledgement

Client has read, signed and received a copy of this Agreement and understands and accepts all of the terms and conditions set out herein.

Ohana Concierge

Property WATCH SERVICE AGREEMENT

SERVICES & FEE SCHEDULE

BASIC SERVICES INCLUDE:

Exterior Inspection list: Ensure all entrances are secure; visual check for evidence of forced entry, vandalism, theft or damage; check outside faucets and hoses for leaks; removal of newspapers, flyers, packages, mail and other evidence of non- occupancy; visual inspection of roof & gutters from the ground and visual inspection of yard/landscaping and winter checks for snow loads.

Interior Inspection list: Inspect for signs of theft, vandalism, damage or other disturbance; check that all windows and entryways are secure; check security system is set and working properly; note any unusual odors; visual inspection of walls, ceilings, windows, tubs, showers for evidence of water damage, leakage, mold or mildew; check that thermostat is set at correct temperature; check that freezers & refrigerators are working; visual check of heating system and hot water heater. The following rates are per inspection.

ADDITIONAL SERVICES BY REQUEST:

Meet Service Providers/Deliveries: $55.00 First hour and $35-55 each thereafter, minimum 1 hour charge.

Opening Services: N/A (does not include plumbing or electrical fees if required)

Emergency After Hours Services: $95.00 First Hour and $35-55 per hour thereafter, minimum 1 hour charge.

Alarm Call Out Service: Emergency ALARM Response call out service where we are on call 24 hours per day 7 days a week. Yearly $150.00 Fee. Monday to Friday 8:00am to 5:00pm call out rate is $55.00 per hour and after hours call out rates are $95.00 per hour with $35-55 each hour thereafter.

If you would like Emergency Response Services, please notify your alarm company that Ohana Concierge is a key holder and not a security company. As such, we will respond to alarm notification in as timely a fashion as scheduling permits. Service call charges include property inspection after alarm notification and rearming system. Owner will be notified if there are any visible signs of intrusion or damage, and will be sent an electronic report.

Post – Storm Inspections: $55.00 per visit

At your request we will check on your property after any major storm that passes through the area. Post-storm, we will inspect your property, look for visible signs of damage, take photos if necessary, and send a detailed report to owner. If required we can act on your behalf to minimize any further damage by fixing or contacting the proper contractors to repair any damages found.

Ohana Concierge employee’s required to stay at the property for extended periods until damages have been repaired will be billed out at $35-55 per hour after the first hour.

SPECIAL INSTRUCTIONS SPECIFIC TO THIS PROPETY:

INSPECTION REPORTS:

Each Home Watch Property Patrol is documented by an electronic Property Watch Report. This report is generated during the Patrol and is provided to the owner immediately after each patrol is completed.

A patrol inspector arrives at the home or cottage to perform a complete inspection on the property. There is a QR code posted at the property. The inspector uses a smart phone or tablet with 4G signal and scans the QR code. The inspector logs in to access the owners site specific inspection questions list. When the inspector logs in this automatically records the date, time & GPS position as proof that we have been to the customers property. The inspector completes the property patrol while filling in the pre set list of questions created by the owner & Ohana Concierge. representative custom to each property. When the watch / patrol has been completed and the inspector hits submit this then sends either an SMS text or e-mail to both the Admin at Ohana Concierge and the property owner. This lets them both know that the inspector has completed the inspection and that they can now log onto the company web site and see their custom report. All reports are kept on the company server for 1 year after submission date.

It is very important that the owner review their reports each time they are submitted as they identify any problems encountered or unfortunate issues that may have happened. This will give the owner the opportunity to work with Ohana Concierge to act on their behalf and minimize any further damages.
